3. Image Rights and Prohibitions

You represent and warrant that:

• You own or have obtained all necessary rights, licenses, and permissions to use and upload all images you provide
• You have the legal right to consent to the use of images of any children depicted in uploaded photos
• You will not upload images of other people's children without explicit written consent from their parent or legal guardian
• All images comply with applicable child protection laws and regulations

4. Right to Refuse Service

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including but not limited to cases where:

• You violate these Terms of Service or our Privacy Policy
• You upload images without proper authorization or consent
• You engage in fraudulent, abusive, or illegal activity
• You attempt to circumvent our security measures or payment systems
• We determine that providing service would violate applicable laws or regulations

5. Payment Terms and Refund Policy

Payment

All payments are processed securely through Stripe. By making a purchase, you agree to pay all charges associated with your order. Prices are subject to change without notice, but changes will not affect orders already placed.

Refund Policy

Refunds may be available under the following circumstances:

• If we are unable to complete your order due to our error
• If you cancel your order before production begins
• As otherwise required by applicable consumer protection laws

Refund requests must be submitted within 30 days of order completion. Refunds will be processed to the original payment method within 5-10 business days.

6. Limitation of Liability

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from or related to your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for delays or failures in performance resulting from circumstances beyond our reasonable control

7. Intellectual Property

User Content

You retain ownership of all photos and images you upload to our service. By uploading content, you grant us a limited, non-exclusive license to use, process, and store your images solely for the purpose of creating and delivering your personalized book.

Generated Content

All generated content, including but not limited to illustrations, layouts, designs, and text created by our service, is owned by us or our licensors. We grant you a personal, non-transferable license to use the generated content solely for your personal, non-commercial use.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any generated content without our express written permission.

8. Account Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Uploading unauthorized images
• Non-payment of fees
• Any other reason we deem necessary to protect our service or users

Upon termination, your right to use the service will immediately cease. We may delete your account and all associated data, subject to our data retention policies outlined in our Privacy Policy.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on our website and updating the version number and date. Your continued use of the service after such changes constitutes acceptance of the modified terms.
